Right To Be Forgotten

The Health and Youth Care Inspectorate (IGJ) monitors and promotes the safety and quality of health care and youth care. In order to be able to monitor, we as an inspectorate also have to process personal data. Personal data are, for example, someone’s name, address and telephone number. Sometimes we also need to process sensitive personal data, such as a person’s medical data. We call this special personal data Right to be forgotten law.

In our privacy policy we explain how we handle your privacy. You can submit a GDPR request to us via the AVG request form .

Since 25 May 2018, the General Data Protection Regulation (GDPR) applies. This means that the same privacy legislation applies throughout the European Union (EU). Among other things, the GDPR strengthens and expands the privacy rights of citizens and more responsibilities for organizations.

What are your privacy rights?

You can submit a GDPR request to us and defend one or more of your privacy rights:

  • The right of access. This means that you may ask us whether we process personal data about you and why.
  • The right to correction (correction and addition). This means that you may ask us to change the processed personal data.
  • The right to restriction of processing. This means that you may request the inspectorate not to process and adjust any personal data about you temporarily.
  • The right to be forgotten (forgetfulness).

You can find more information about your privacy rights in chapter 3 of our privacy policy .

How do you submit a GDPR request?

Do you want to make use of one or more of your privacy rights? Then you can submit a GDPR request to us:

  • Download the GDPR request form .
  • Fill in the form.
  • Include a copy of a valid ID, such as a passport or ID. Here you can read how to do that safely.
  • Send the completed form together with the copy of the proof of identity. This can be done digitally or in writing:

    Digital
E-mail the completed form to meldpunt@igj.nl

    In writing (printed form)
    Health and Youth Care Inspectorate
    PO Box 2518
    6401 DA Heerlen

Who can you submit a GDPR request for?

You can only submit a GDPR request to assert your own privacy rights. You should not submit a GDPR request to defend someone else’s privacy rights. That is also the reason why we ask you to add a copy of your proof of identity to your GDPR request. This way we can be sure that you submit the request yourself, and not someone else. Exceptions to this are authorization and legal representation.

Are you unable to submit a GDPR request yourself, or are you not allowed to?

You can authorize someone if you do not want to submit a GDPR request yourself. That person then makes the request on your behalf. The AVG form states which data you must send in addition to the authorization.

Are you younger than 16 years old? Or are you under guardianship? Then you are not allowed to submit a GDPR request yourself. Your legal representative can submit a request on your behalf. The AVG form states which data your legal representative must send.

When can we reject your request?

We may decline your GDPR request. If so, we will send you a letter explaining why we are rejecting your request. We may decline a request for a variety of reasons. A few examples:

  • We do not process any of your personal data.
  • We need the data to monitor healthcare and youth care.
  • We need the data to prevent, investigate or detect criminal offences.

We always carefully weigh all interests before deciding whether to approve or deny a request.

How long does it take before you receive a message?

The type of GDPR request you have submitted determines how quickly you will receive a substantive response from us:

  • Have you submitted a GDPR request to us? And isn’t that request big or complicated? Then we will send you a response to your request within one month at the latest. This response is a decision.
  • Have you submitted a large or complex GDPR request? Then we can take 2 months longer about your request and you will receive a message about this. We will send you our decision on your GDPR request within 3 months at the latest.
